Marktueberwachungsstelle der Laender fuer die Barrierefreiheit von Produkten und Dienstleistungen (MLBF), the joint federal-states market surveillance authority is the designated national authority.

Scope

Applies to economic operators placing in-scope consumer products on the German market and to providers of in-scope services (e-commerce, consumer banking, e-books, electronic communications, passenger transport information, telephony services) to consumers in Germany from 28 June 2025. Microenterprises (fewer than 10 employees AND annual turnover or balance-sheet total up to EUR 2 million) providing services are exempt from the substantive service requirements, per Section 3 BFSG in combination with the EAA. Product obligations for microenterprises are lighter but not eliminated.

Practical notes

Before the MLBF was created, enforcement was to be handled by individual Laender authorities; the sixteen federal states then agreed to establish a joint body (MLBF) based in Magdeburg. Enforcement patterns and publicly reported decisions are not yet established as of the research date.
