Enforcement body

Multiple authorities designated in Article 16 of Loi 2023-171: officers of the DGCCRF (Direction generale de la Concurrence, de la Consommation et de la Repression des Fraudes), together with sector regulators ARCEP, ARCOM, ACPR, AMF and Banque de France for their respective sectors is the designated national authority.

Scope

Applies to manufacturers, importers, distributors and service providers placing in-scope products on the French market or providing in-scope services to French consumers from 28 June 2025 (confirmed in Article 16, Section VIII.A of Loi 2023-171). In-scope services include e-commerce, consumer banking, e-books, electronic communications and passenger transport information. Article 16 exempts undertakings with fewer than 10 employees AND annual turnover not exceeding EUR 2 million from the substantive service requirements (microenterprise exemption).

Practical notes

Decret 2023-931 sets out product marking, technical documentation and market surveillance requirements. The Loi 2023-171 URL on Legifrance was corrected from JORFTEXT000047276873 (non-existent) to the confirmed JORFTEXT000047281777 during this audit. Public enforcement pattern for private operators is not yet established as of the research date.
