Autoriteit Consument en Markt (ACM) – e-commerce and electronic communications services; AFM for banking services; Commissariaat voor de Media (CvdM) for audiovisual and e-books; RDI for electronic interactive products; ILT for passenger transport is the designated national authority.

Scope

Applies to economic operators placing in-scope products on the Dutch market and to service providers offering in-scope services (e-commerce, consumer banking, e-books, electronic communications, passenger transport information) to Dutch consumers from 28 June 2025 (effective date confirmed on wetten.overheid.nl for BWBR0049571). The Act works by amending multiple sectoral laws (including Warenwet, Wet op het financieel toezicht, Burgerlijk Wetboek). Under the parent EU Directive 2019/882 (EAA), Article 4(5), microenterprises providing services (fewer than 10 staff AND turnover or balance-sheet total up to EUR 2 million) are exempt from the substantive service requirements; this exemption is understood to carry through into Dutch law via the amended sectoral acts but the specific transposing provision was not located during this audit.

Practical notes

The Implementatiewet works largely by amending existing sectoral legislation rather than creating a single new code, which means the applicable requirements for a given business depend on the sector. Publicly reported enforcement decisions are not yet established as of the research date; ACM has publicly indicated an active monitoring and reporting regime is in place.
